Beneficial ownership with insurance companies.
No share of “Aon Baltic” shares or other capital belongs to any other insurance company or parent entity of the insurance company. The management of “Aon Baltic” is in no way affected by any insurance company or parent company of the insurance company. “Aon Baltic” does not have any shares or other capital in the insurance company and/or influence on its direct or indirect management.
Complaints regarding the activities of insurance brokers can be submitted to authorities
Complaints regarding the activities of insurance brokerage companies and/or compensation of damages can be submitted directly to Žilvinas Petrauskas, Director of “Aon Baltic”, “Lietuvos bankas” or may be brought before a court in accordance with the procedure laid down by the law. Complaints regarding the activities of “Aon Baltic” employees – activities of insurance brokers and violation of their professional ethics can be submitted to the Chamber of Insurance Brokers at www.dbr.lt.
Procedure for Resolving Insurance Intermediaries’ Complaints and Disputes Through Out of Court Settlements
If you believe that “Aon Baltic” has violated your rights or legitimate interests arising from the contracts or related relationships, and you are going to contact “Lietuvos bankas” regarding the resolution of the dispute, you must first contact “Aon Baltic” in writing, indicate the circumstances of the dispute and specify your claim. You are free to apply in person to any division of “Aon Baltic” or send by post to address A.Goštauto 40B, LT-03163, Vilnius or contact us by email aonbaltic@aon.lt. Your application will be processed within 30 calendar days from the date of receipt – in exceptional cases, the time limit may be extended. Examination of application is free of charge.
If you (the policyholder, the insured, the beneficiary or the injured third party) are a consumer (i.e. a natural person whose personal (not related to your business or professional activities), family or household needs are covered by an insurance), and “Aon Baltic” does not satisfy your claim, wholly or partly, then you are entitled to apply to “Lietuvos bankas” (Žirmūnų g. 151, 09128,Vilnius, www.lb.lt) for an out-of-court settlement of a dispute pursuant to the Law on Lietuvos bankas and the Rules for the out-of-court procedure of settlement of the disputes between consumers and financial market participants approved by the Board of Lietuvos bankas (Bank of Lithuania).
If “Aon Baltic” does not satisfy your claims or partially satisfy them, you also have the right to bring it before a court in accordance with the procedure laid down by the law.
Recommendation
“Aon Baltic” will not advise you on insurance products unless otherwise stated in the insurance offer.
Remuneration for Insurance Brokerage Services
According to legal requirements, “Aon Baltic” states that it receives remuneration for insurance intermediation services in the form of a commission fee from the insurer. Prior to the conclusion of the insurance contract, “Aon Baltic” will inform you in all cases if you have to pay that remuneration directly and/or will specify if remuneration is in the form of economic advantage, to which the contract relates.
The Nature of Consultation
In consultation with you, “Aon Baltic” acts as an insurance intermediary – an insurance brokerage company that carries out the activity of insurance mediation on behalf of both the client (the policyholder, the insured, the beneficiary or injured third party) and the insurance company (insurer). Nevertheless, “Aon Baltic” makes sure that the insurance activities in all cases are carried out in accordance with the best interest of the customer (policyholder, insured, beneficiary or injured third party). The names and other information about the insurance companies (insurers) we cooperate with will be provided to you by the insurance broker.
Information to be submitted to the policyholder under Article 6.993 of the Civil Code of the Republic of Lithuania at conclusion of an insurance contract by the insurer.
The following information shall be provided to the client when concluding the insurance contract: the name of the insurer, the type of the insurer’s company, the address, the address of the insurer’s unit or address of the representative, the dispute settlement procedure arising from or related to the insurance contract, the insurer’s behavior when the policyholder violates the terms of the insurance contract, possible causes of increased risks and other terms and conditions of the insurance contract. You can find all relevant information under the rules of the particular type of insurance contract (policy) concluded by you, whereas other information relating to the legal provisions on insurance activities is available at www.lb.lt. “Aon Baltic” draws your attention to and strongly recommends that you familiarize yourself with the insurance terms and conditions of the insurance products offered to you, and/or suggests you to ask your insurance broker to provide more detailed information in that regard. If the policyholder violates the terms and conditions of the insurance contract, the insurer shall have the right to keep the insurance contract terminated, suspend the validity of the insurance cover, propose to change the insurance contract, terminate the insurance contract before the due date, request to cause the insurance contract under the conditions and in accordance with the procedure set forth in the insurance contract to be invalid, refuse to pay the insurance benefit or reduce it and/or apply other measures provided for in the insurance contract. In addition, we note that potential instances of an increase in insurance risk are also set out in the insurance contract (in particular provided for by the Insurance Rules).
Law Applicable to Insurance Contracts
The law of the Republic of Lithuania shall apply to insurance contracts where “Aon Baltic” acts itself as an insurance intermediary unless otherwise stated in a written proposal or insurance contract.
Processing of Personal Data
Your personal data is processed for the purpose of insurance mediation. “Aon Baltic” may obtain and provide personal data to companies engaged in insurance or insurance mediation activities, Financial Crime Investigation Service, State Tax Inspectorate under the Ministry of Finance of the Republic of Lithuania, Supervision Board of the Bank of Lithuania, Motor Insurers’’ Bureau of the Republic of Lithuania, State Enterprise REGITRA, and State Enterprise Center of Registers.
You shall have a right of direct access without constraint to all data relating to him/her that are processed and, as appropriate, the right to the rectification, erasure or blocking of data by submitting a written request. You shall also have a right of direct access to the following information:
- from which sources and what personal data has been collected;
- purposes and means of the collection and processing of the personal data;
- Information on the list of recipients which are allowed (were allowed) access to your personal data (including data that was provided in the past) over the past one year preceding the date of application.
You may submit any request concerning the processing of your personal data in person by arriving at any “Aon Baltic” unit and by presenting a valid personal identification document to “Aon Baltic” employee or by sending an email aonbaltic@aon.lt according to the procedure established by legal acts, by means of electronic communication, which allow to properly identify the person who has confirmed his/her identity. The request must contain the name, contact details, personal identification number of the person and the reason for the request. “Aon Baltic” provides information on personal data processed to the data subject free of charge.
